Davut Schwartz, Ripple’s CTO, has firmly denied accusations of negligence and wrongful death in the lawsuit against AI chat platform Character.AI. Schwartz took to social media to declare the lawsuit legally invalid, stating that Character.AI’s actions are protected by the First Amendment of the US Constitution. The lawsuit was brought by the mother of Sewell Setzer III, a 14-year-old who tragically passed away after extensive interactions with Character.AI’s chatbots.
The lawsuit, filed by Setzer’s mother, alleges negligence, wrongful death, misleading trade practices, and product liability. It claims that Character.AI failed to implement necessary safety measures to protect its young users. Setzer apparently interacted frequently with chatbots that simulated popular media characters on the platform prior to his death.
In response to the lawsuit, Character.AI announced that it has updated its safety protocols. These updates include age-based content filters and mechanisms to detect harmful interactions, all in an effort to enhance user safety. The company also expressed deep sorrow over the loss of a user and extended heartfelt condolences to the family.
While committing to improving safety measures, Character.AI also made it clear that it intends to fight the legal battle. Schwartz stressed the importance of striking a balance between freedom of speech and corporate responsibilities, highlighting flaws in the legal arguments presented in the case. These statements reignite the ongoing debate surrounding the legal and ethical obligations of technology companies.
The security measures implemented by Character.AI following the lawsuit, as well as Schwartz’s statements, prompt contemplation on how to maintain a delicate equilibrium between freedom of speech and user safety within the tech industry.
